Terms & Conditions

Please read these Terms and Conditions carefully before engaging Domara for any household records organisation or administrative information support service. By proceeding with an enquiry, booking a session or making payment, you confirm that you have read, understood and agreed to these terms.

2. Acceptance of Terms

By submitting an enquiry, confirming a booking or making payment to Domara, you acknowledge that you have read and agree to this Agreement. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law. If you are engaging on behalf of another household member, you confirm that you have their authority to do so.

3. Service Description

Domara provides administrative information and organisational support for household document management. This encompasses:

Services are available to households located in the Johor Bahru area. Sessions may be conducted at our office or at the client's home by prior arrangement. Services are provided in English and Bahasa Malaysia.

3.1 What is not included

Domara does not provide legal, financial, medical, tax or any other form of regulated professional advice. We do not represent clients before government agencies, courts, financial institutions or any official body. Where a matter requires a qualified professional, we will note this in the scope document or Boundaries Card but will not provide referrals or recommendations.

5. Intellectual Property

All templates, filing guides, index formats and written materials produced by Domara during a programme are provided for the personal use of the client household. They may not be reproduced for commercial purposes, shared publicly or distributed without written permission from Domara. The client retains full ownership of all their personal and household documents at all times.

6. Payment Terms

6.1 Fees

Fees are stated in Malaysian Ringgit (RM) and are fixed per programme. Current fees are:

Third-party costs — including official document reproduction charges, archival materials purchased on the client's behalf, or other external fees — are itemised separately in writing before any such expenditure is incurred.

6.2 Payment

Payment is due as follows: 50% on confirmation of booking, 50% on completion of the programme. For the Shelf Session, full payment is due before the session date. Payment may be made by bank transfer or such other methods as communicated at the time of booking.

6.3 Cancellation and refunds

7. Service Delivery Terms

7.1 Scope

A written scope document will be provided before each programme begins. Work will not commence until the client has acknowledged the scope. Any additions to the scope during delivery must be agreed in writing and may attract additional fees.

7.2 Timelines

The Shelf Session is a single session of approximately three hours. The Renewal Calendar service runs for twelve months from the start date. The Family Archive Establishment Programme runs for approximately four months with weekly sessions. Timelines may be adjusted by mutual agreement.

7.3 Client documents

Original documents remain in the client's possession throughout. Domara will not remove originals from the client's property without specific written agreement. Digitised copies are delivered to the client and are not retained by Domara after delivery.

7.4 Confidentiality

Domara treats all household information encountered during a session as confidential. Team members will not discuss, share or reference the contents of client documents outside the working context of the programme.

Domara's services are administrative and informational in nature. We make no representation that:

Services are provided based on reasonable professional care appropriate to administrative support work. We do not provide advice and no information we share constitutes professional advice of any kind.

9. Limitation of Liability

To the fullest extent permitted by Malaysian law, Domara's total liability to a client for any claim arising from or related to a programme shall not exceed the fee paid for that programme. We are not liable for indirect, consequential or special loss, including loss of opportunity, loss arising from a missed renewal or any third-party action or inaction.

We are not liable for loss or damage to documents during sessions unless caused by our direct negligence. Clients are responsible for maintaining adequate copies of important documents independently of any programme with Domara.

10. Indemnification

You agree to indemnify and hold harmless Domara, its team members and contractors from any claim, loss, damage or expense (including reasonable legal fees) arising from your breach of this Agreement, your misrepresentation of documents or your negligent or unlawful conduct during a programme.

11. Termination

Either party may terminate the Agreement with written notice at any time. If the client terminates, cancellation terms in Section 6.3 apply to any balance due. If Domara terminates due to the client's breach of this Agreement, no refund will be due for work already completed. On termination, any materials prepared up to that point will be provided to the client and all client documents returned.

12. Dispute Resolution

This Agreement is governed by the laws of Malaysia. In the event of a dispute, the parties agree to first attempt resolution through direct written communication. If unresolved within 30 days, the parties may refer the matter to mediation under the auspices of the Malaysian Mediation Centre before initiating legal proceedings. The courts of Johor Bahru, Johor shall have non-exclusive jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised effective date. For existing engagements in progress, we will notify you by email of any material changes. Continued use of our services after the effective date constitutes acceptance.
